ISHRS E-Mail Advertising Agreement & Terms of Use

By purchasing an email advertising opportunity from the International Society of Hair Restoration Surgery (“ISHRS”), the purchaser (“Purchaser”) agrees to the following Terms & Conditions.

1. General Eligibility & Approval

1.1 Submission of an application and payment does not guarantee approval.

1.2 All e-mail blast applications are subject to review and approval by the ISHRS Exhibits & Advertising Review Committee at its sole and absolute discretion.

1.3 ISHRS reserves the right to reject, cancel, suspend, or remove any application, advertisement, content, or scheduled e-mail blast at any time, with or without cause, including but not limited to content deemed:

  • False, deceptive, misleading, defamatory, or inappropriate;
  • Non-compliant with applicable laws or regulations;
  • In conflict with ISHRS policies, values, mission, or member interests;
  • Competitive, unethical, or potentially damaging to the reputation of ISHRS.

1.4 ISHRS reserves the right to determine whether a Purchaser’s products, services, or messaging are appropriate and relevant to ISHRS members.

1.5 The Purchaser must be in good standing with ISHRS and have no outstanding balances, unpaid invoices, disputes, or prior violations of ISHRS policies.

2. Deliverables Included

Upon approval and full payment, the Purchaser will receive:

  • One (1) dedicated commercial e-mail blast distributed by ISHRS to eligible recipients within the ISHRS mailing database;
  • One (1) resend of the same e-mail blast to non-openers approximately three (3) business days after the initial distribution;
  • Up to three (3) test proofs for review prior to deployment;
  • Standard performance metrics including:
    • Total delivered
    • Open rate
    • Click rate (if applicable)

ISHRS does not guarantee:

  • A minimum number of recipients;
  • Delivery rates;
  • Open rates;
  • Click-through rates;
  • Leads, sales, conversions, responses, or business outcomes.

Recipient counts may vary based on member status, subscription preferences, opt-outs, and database changes.

3. Fees & Payment Terms

3.1 The total cost for one (1) e-mail blast package is USD $2,500.

3.2 A non-refundable application and review fee of USD $250 is required at the time of submission.

3.3 If the application is approved, the USD $250 application fee will be applied toward the total balance.

3.4 If the application is rejected by ISHRS, the Purchaser will receive a refund of USD $2,250.

3.5 Chargebacks, payment disputes, reversed transactions, or fraudulent claims related to the application fee or approved purchase may result in:

  • Immediate cancellation of the e-mail blast;
  • Permanent suspension from future ISHRS advertising opportunities, meetings, sponsorships, memberships, exhibitions, or events;
  • Collection actions for unpaid balances, legal fees, or associated costs where permitted by law.

4. Content Requirements

4.1 All submitted content must:

  • Be professional, accurate, and legally compliant;
  • Clearly identify the advertiser;
  • Avoid deceptive, misleading, offensive, or exaggerated claims;
  • Comply with all applicable advertising, privacy, anti-spam, intellectual property, and healthcare-related regulations.

4.2 The Purchaser is solely responsible for:

  • All claims, representations, and statements made within the advertisement;
  • Securing all rights, licenses, permissions, and approvals for submitted content, images, trademarks, and links;
  • Compliance with all applicable laws and regulations.

4.3 ISHRS does not independently verify claims made within advertisements and assumes no responsibility or liability for advertiser content.

4.4 ISHRS reserves the right to request revisions, edits, or removal of content prior to distribution.

4.5 Purchasers may submit:

  • HTML files;
  • Image assets;
  • Subject lines;
  • Hyperlinks;
  • Mock-up designs.

Submission of incomplete or improperly formatted materials may delay scheduling.

4.6 Use of the names “International Society of Hair Restoration Surgery,” “ISHRS,” logos, branding, trademarks, or implied affiliation is strictly prohibited unless expressly authorized in writing by ISHRS.

5. Scheduling & Distribution

5.1 ISHRS will make reasonable efforts to distribute the e-mail blast on the requested date; however, all scheduling is subject to availability, internal calendar conflicts, holidays, technical limitations, and operational considerations.

5.2 ISHRS reserves the right to reschedule any distribution date at its discretion.

5.3 ISHRS limits commercial e-mail blast distributions to no more than one (1) commercial advertiser per calendar month.

5.4 E-mail blasts will be distributed only to recipients within the ISHRS database who have not opted out of receiving marketing communications.

5.5 ISHRS will not share, sell, transfer, or provide its mailing list or recipient data to the Purchaser.

6. Required Disclosures

6.1 All distributed advertisements will include:

  • A visible “ADVERTISEMENT” designation;
  • An ISHRS disclaimer statement.

6.2 ISHRS reserves the right to determine the placement, wording, formatting, and visibility of all required disclosures.

7. Limitation of Liability

7.1 ISHRS shall not be liable for:

  • Technical issues;
  • Delivery delays;
  • E-mail filtering;
  • Spam blocking;
  • Formatting inconsistencies;
  • Third-party platform failures;
  • Data inaccuracies;
  • Lost business opportunities;
  • Indirect, incidental, consequential, special, or punitive damages.

7.2 ISHRS’s total liability under this agreement shall not exceed the total amount paid by the Purchaser for the applicable e-mail blast.

8. Indemnification

The Purchaser agrees to defend, indemnify, and hold harmless ISHRS, its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:

  • The submitted content;
  • Breach of this agreement;
  • Violation of any law or regulation;
  • Intellectual property disputes;
  • False or misleading advertising claims.

9. Acceptance of Terms

Submission of payment and/or execution of the e-mail blast application constitutes acknowledgment and acceptance of these Terms & Conditions by the Purchaser.

ISHRS reserves the right to modify these Terms & Conditions at any time without prior notice.
